Our StoryDE x WFM Competition – TERMS & CONDITIONS
1. PROMOTER
This competition is organized by Hero UK&I on behalf of Deliciously Ella ("Promoter", "we", "us", "our"). Hero UK&I Ltd is a subsidiary of Hero Group, a company incorporated in Switzerland.
2. COMPETITION PERIOD
(a) Opening date: 23rd September. 8:00am
(b) Closing date: 29th September 8:00pm
(c) Entries received after the closing date will not be counted.
3. ELIGIBILITY
(d) This competition is open to residents of the United Kingdom aged 18 or over, except where stated otherwise in the competition post.
(e) The following persons are not eligible to enter: employees of Hero UK&I Ltd, associated brands (including Deliciously Ella, Organix, and Goodies), and any partner companies, agencies, or suppliers directly involved in this promotion.
4. HOW TO ENTER
To enter, participants must complete all of the following steps before the closing date:
(f) Purchase at least 1 x Deliciously Ella product in store from Whole Foods Market Kensington.
(g) Show the Deliciously Ella team, then scan the QR code provided at the sampling table.
(h) Follow the steps to enter the competition.
Entry Restrictions:
(i) Entries made using automated means, bulk entry software, fake accounts, multiple accounts, or any other method that is not in accordance with the spirit of these Terms & Conditions will be disqualified.
(j) Internet access and a valid email address are required to enter.
5. THE PRIZE
Winner(s) will receive: A Deliciously Ella tote bag, DE cap, DE water bottle, a selection of DE snacking products, and £50 WFM voucher to spend within store.
(k) The prize is non-transferable, non-refundable, and cannot be exchanged for cash or alternatives unless agreed in writing by the Promoter.
(l) The Promoter reserves the right to substitute the prize with another of equal or greater value if the original prize becomes unavailable for reasons beyond our reasonable control.
(m) Any tax liability arising from the acceptance of the prize is the sole responsibility of the winner.
6. WINNER SELECTION & NOTIFICATION
(n) 1 x winner will be selected at random from all valid entries received before the closing date.
(o) The winner selection will take place on or around 29th September 2026 and will be notified via email within 14 days of the closing date.
(p) If a winner does not respond within 7 days of notification, or if they decline the prize, we reserve the right to select an alternative winner using the same selection method. This process may be repeated as necessary.
(q) The Promoter's decision on all matters relating to the competition, including winner selection and eligibility, is final and binding. No correspondence will be entered into.
7. DATA PROTECTION & PRIVACY
The Promoter takes your privacy seriously. This section explains how we collect, use, and protect your personal data in connection with this competition.
(r) Data Controller: Hero UK&I Ltd is the data controller for personal data collected in connection with this competition. Our registered address is 120 Commercial Road, Bournemouth. For data protection queries, please contact us at hello@deliciouslyella.com.
(s) Personal Data Collected: We collect and process the following personal data in connection with this competition: name, email address, postal address for prize delivery, and any content submitted as part of your entry. Winners may be required to provide additional information for prize fulfilment purposes.
(t) Legal Basis for Processing: The legal basis for processing your personal data is: (a) our legitimate interest in administering the competition, verifying eligibility, and selecting a winner (Article 6(1)(f) UK GDPR); and (b) where required for prize fulfilment (e.g., obtaining your postal address for delivery), performance of a contract (Article 6(1)(b) UK GDPR).
(u) Purpose of Processing: Your personal data will be used solely for the purposes of: administering this competition; verifying eligibility; selecting and notifying winner(s); prize fulfilment; and (where you have consented or where we have a legitimate interest) publicizing the competition results.
(v) Marketing Communications: We will not use your personal data for direct marketing purposes unless you have separately opted in to receive marketing communications from us. If you have opted in, you may withdraw your consent at any time.
(w) Data Sharing: Your personal data may be shared with: (i) our prize fulfilment partners solely for the purpose of delivering the prize; (ii) our social media management tools and platforms; (iii) our parent company, Hero Group; and (iv) professional advisers where necessary. We will not sell your personal data to third parties.
(x) Data Retention: Your personal data will be retained for 3 months after the competition closes for the purposes of prize fulfilment, dealing with any queries, and complying with our legal obligations, after which it will be securely deleted unless we are required to retain it for a longer period by law.
(y) Your Rights: Under UK GDPR, you have the right to: access your personal data; request rectification of inaccurate data; request erasure of your data; restrict or object to processing; data portability; and lodge a complaint with the Information Commissioner's Office (ICO) at www.ico.org.uk. (z) International Transfers: Your personal data will not be transferred outside the United Kingdom unless adequate safeguards are in place in accordance with UK GDPR, including the use of Standard Contractual Clauses or transfers to countries with an adequacy decision.

8. LIABILITY
(bb) Nothing in these Terms & Conditions shall exclude or limit the Promoter's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited under applicable law.
(cc) Subject to the above, the Promoter and any associated partners, agencies, or suppliers shall not be liable for: (i) entries not received, delayed, corrupted, or misdirected due to technical failures, connectivity issues, platform outages, or any other cause beyond our reasonable control; (ii) any loss, damage, or injury arising from acceptance, possession, or use of the prize, except where caused by the Promoter's negligence; (iii) any delays, cancellations, or modifications to the prize due to circumstances beyond our reasonable control; (iv) any failure by a third-party prize provider to fulfil their obligations.
(dd) The Promoter reserves the right to modify, suspend, or cancel the competition at any time if circumstances beyond our reasonable control make it necessary, including (without limitation) technical failures, acts of God, pandemics, government action, or changes in applicable law. Where possible, notice will be given via the original competition post and/or the Promoter's social media channels.
9. DISQUALIFICATION
The Promoter reserves the right, at its sole discretion, to disqualify any entrant who:
(ee) Tampers or attempts to tamper with the entry process, the operation of the competition, or any website or platform associated with the competition;
(ff) Violates these Terms & Conditions or any applicable laws or regulations;
(gg) Acts in a manner that is unsportsmanlike, disruptive, annoying, or with the intent to abuse, threaten, or harass any other person, including other entrants, the Promoter's staff, or social media users;
(hh) Uses multiple accounts, automated means, scripts, bots, or third-party services to enter;
(ii) Provides false, misleading, or inaccurate information;
(jj) Engages in any conduct that the Promoter reasonably believes is contrary to the spirit or intent of the competition.
10. GENERAL
(kk) By entering this competition, you confirm that you have read, understood, and accepted these Terms & Conditions in full.
(ll) These Terms & Conditions are governed by and shall be construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this competition shall be subject to the exclusive jurisdiction of the courts of England and Wales.
(mm) If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.
(nn) The Promoter's failure to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision.
